PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ENGAGING RETREAT WORKS. PURCHASING RETREATS, EVENTS, COACHING AND/OR CONSULTING SERVICES INDICATES ACCEPTANCE OF THESE TERMS.

The following are terms of a legal agreement between you and Exit 108 Consulting LLC d.b.a. Retreat Works (“Company”, “we”, “us”) By purchasing services from Company, you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations.

1.MEDICAL ATTENTION: Should Client require emergency medical treatment as a result of accident or illness arising during attendance or participation in retreat event, Client consents to such treatment. Client acknowledges and agrees to be financially responsible for any medical or legal bills that may be incurred as a result of emergency or non-emergency medical treatment. 2. REFUND POLICY AND CANCELLATIONS: Retreats and event weeks are 70% refundable up to 120 days before the event. After the 120 days, down payments and full payments are 0% refundable. Cancellations shall take effect within a 5-day period after the written request.

3. EMERGENCY CANCELS FOR RETREATS & EVENTS: In the event that the client has an emergency situation that does not allow for them to attend, if there is a future event the client desires to attend, the company may elect to invite the client to another event. This may or may not be the same type of retreat originally offered. Rescheduled retreats must be rescheduled within one year of the original purchase date. Retreats may only be rescheduled once. Retreat Works is not liable for and does not reimburse down payments, retreat fees, or air fare for any reason in case of an emergency cancellation.

4. DISASTER CANCELLATION: In case of an event or retreat cancellation due to conditions beyond the Company's control, including but not limited to governmental action, fire, flood, earthquake, natural disaster, power failure, riot, explosion, labor, or material shortage, carrier interruption of any kind or work slowdown, then the retreat will be rescheduled within a reasonable time period. The company will not reimburse airfare.

5. LIABILITY WAIVER: Client accepts all risks to their health that may result from participating in the retreat or activities surrounding the retreat and release Retreat Works, and any of the trainers or staff in attendance for any and all claims and causes of action for loss of or damage to Client’s property and for any and all illness and injury to Client, that may result from or occur during participation of the retreat or activities surrounding the retreat, whether caused by negligence of the promoter or otherwise. Client voluntarily is participating in the retreat with knowledge that travel to foreign countries and/or the remote areas visited by this trip involves numerous risks and dangers including, but not limited to, a risk of illness, injury or death, which may be caused by: forces of nature, civil unrest, terrorism, road conditions, injuries inflicted by animals, insects, reptiles or plants, trails, hotels, vehicles, boats or other means of conveyance which are not operated nor maintained to standards common in the United States; high altitude accident, accident or illness without access to means of rapid evacuation or the availability of medical supplies; the lack of adequacy of medical attention once provided, and negligence on the part of Exit 108 Consulting LLC doing business as Retreat Works, Kim Flynn, their affiliated organizations and their shareholders, employees, trainers or other agencies. Client acknowledges that the enjoyment and excitement of foreign travel/adventure travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and that these inherent risks and the corresponding enjoyment and excitement contribute to the reason for my voluntary participation on this trip. Client further agrees that if, despite this Liability Waiver, the Client, or anyone on their behalf, makes a claim against any of the above released parties, Client will indemnify, save and hold harmless each of the above released parties from any litigation expenses, attorney fees, loss, liability, damage, or cost which may Incur as the result of such claim.

6. PHOTO, VIDEO & COMMENT RELEASE: Client hereby grants Retreat Works permission, with respect to photographs and videos taken and/or comments made by Client, to copyright for same; to use, reuse and publish the same in whole or in part in any and all media, now or hereafter, and for any purpose whatever.

15. CHOICE OF LAW; EXCLUSIVE VENUE: This Agreement shall be construed in accordance with the laws of the state of Utah, and the parties agree that should any dispute arise concerning this Agreement, venue shall be laid exclusively in a court of competent jurisdiction in Utah County, State of Utah

17. ENTIRE UNDERSTANDING: This document and any exhibit, schedule, or other supplementary document attached constitute the entire understanding and agreement of the parties, and any and all prior agreements, understandings, and representations are hereby terminated and canceled in their entirety and are of no further force and effect.

18. EXECUTION: This agreement is executable upon receipt of a signed agreement or successful payment from Client. By purchasing an event or retreat, or coaching and/or consulting services from Company, you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations.
